If you take on subcontract packages under JCT agreements, you will know the frustration of valuation day. You price the work, put the hours in on site, hand over the package, and submit your monthly application. Then, a few days before the money is due in the bank, an unexpected Pay Less Notice arrives.
Main contractors use these notices to deduct money for disputed contra-charges, unverified site damage, or back-charges. While adjustments are part of standard contract procedure, an unexpected reduction at the end of the month puts immediate pressure on your working capital. When less money lands in your account, it leads to direct Revenue Loss while your suppliers, fuel, van finance, and insurance still need covering on time.
The Commercial Hit to Your Daily Earnings
Most commercial subcontractors price tenders with very lean margins. If your day rate only covers bare labour and standard tools, deductions quickly pull your real earnings below what you need to keep running smoothly:
- Compounded Cash Reductions: When an interim valuation is subject to standard cash retention, CIS deductions, and an unexpected £500 contra-charge all at once, your cash buffer for that month disappears.
- Unbilled Administrative Time: Pulling delivery notes, reviewing site diaries, and drafting challenge letters takes you off the tools. Every unpaid evening spent defending a valuation lowers your effective hourly return.
- Overhead Imbalance: Fixed business costs do not pause because a valuation was cut. When a payment falls short, your personal funds end up carrying the gap.
Illustrative Monthly Cash-Flow Breakdown
This example looks at a 20-day month based on a £288.37 gross daily valuation (£5,767.40 gross application). It compares a clean payment against an illustrative £500 Pay Less contra-charge deduction.
| Valuation Metric | Scenario A: Full Valuation Paid | Scenario B: £500 Pay Less Deduction |
|---|---|---|
| Assumed Gross Valuation (20 Days @ £288.37) | £5,767.40 | £5,767.40 |
| Less 5% Retention Withheld (Illustrative) | -£288.37 | -£288.37 |

Under Section 111 of the Housing Grants, Construction and Regeneration Act 1996, a contractor intending to pay less than the notified sum must follow distinct commercial rules:
- Strict Notice Windows: The notice must be served within the period set out in the subcontract particulars. If the Pay Less Notice is served late or is otherwise ineffective, the payer may be unable to withhold the notified sum for that payment cycle. The underlying deduction or contra-charge may still remain a separate dispute. To see how your dates map out, use my free JCT Subcontract Payment & Notice Deadline Calculator.
- Clear Basis of Calculation: The notice must state the sum considered due and the basis on which it was calculated. Supporting invoices, photographs, and site records may be important evidence later, but they are not automatically required to be attached to every notice.
- Contractual Set-Off Rights: A contractor should not assume that an unrelated dispute on another project can automatically be deducted from this payment. Check for express cross-contract set-off wording and consider whether any separate equitable set-off argument is being relied upon.
